Emperor and Autocrat of Lehmark
His Imperial Majesty, William Lehman I Emperor and Autocrat of Lehmark is the founder and current Sovereign Ruler and Head of State/Government of the Empire of Lehmark.
Reasons for Founding Lehmark
During my younger years, I dreamed of a political career, so when I turned 18 I campaigned for local government, joined the South Australian Labour Party and begun working in an electorate office supporting a State Member of Parliament. I may have lost the local election by 100 votes, but I was more shocked with what happened after - after the election I was tossed aside. This begun my political awakening, I begun to realise that the system we had was broken, the politicians, and the politics themselves, every was wrong the system.
Over the next few years, I got to witness Australia's "revolving door Prime Minister", did not matter who we voted for the Party Room would vote them out and replace them every 6 - 12 months. Australia had 5 Prime Minister's between 2007 and 2015. At one point it was so bad that during a meeting Chancellor Angela Merkel was photographed having a dossier on the current Prime Minister of the time.
I had always said I thought I could a better job, create a freer, more equal society and after viewing a 5 - 10 minute document on YouTube featuring the Queen of Ruritania, and other micronationalists, I found my political calling.
Micronationalism to me was a way to express my political thoughts and ideologies without major repercussions on a wider society. And as a micronation we would have a better chance to hear everyone's thoughts and options, allowing us to better implement our ideas and make sure everyone had a chance to participate.
I chose to found Lehmark on the basis of autocracy and absolutism because I lost faith in the idea of democracy and parliamentarianism in its current form. It was my goal to found a nation where the Head of State/Government had absolute power to direct the politics and policies of the nation, but on the other hand the Citizens had inviolable rights and protections. Not only to prevent political abuse, but also to ensure that every one who became a Citizen of Lehmark would be entirely equal under the law.
By building the system that we are I hope, I can create a nation where we, break down the walls of injustice, prejudice and the road blocks that exist for a societies progression. The system in its current form is able to adapt and enact change quickly, which is how we can start to build this progression.
Political Nature of Lehmark, The Emperor and Autocrat
Lehmark is classified as an Imperial Constitutional Monarchy. The Constitution of Lehmark provides the Emperor and Autocrat with a number of defined powers to effectively govern the micronation, and he is not impeded by any Legislative Assemblies, Political Parties or Trade Unions as these are forbidden under the Constitution. In saying that, civil rights and protections are very wide ranging under the Bill of Rights so as to ensure the protection of Citizens from political abuse and to ensure their equality under the law.
The Emperor and Autocrat is also the Commander-in-Chief of the Imperial Army.
The Emperor and Autocrat's Legislative/Executive Powers:
The Emperor and Autocrat has the Constitutionally defined legislative Imperial Decrees of Ordinary, Financial, Treaty and Title. These Decrees are not subjected to any review, from another government department or agency. The Supreme Court of Lehmark is formally excluded from revising these documents, however it is expected that in the event an Imperial Decree goes against either the Constitution or Bill of Rights that the Supreme Court would offer advice on its reification.
Imperial Decree's are formally described as:
Ordinary Decree which is any Decree that is not covered by a Financial, Treaty, Title or Constitutional Decree.
Financial Decree which is a Decree relating to the Annual Government Budget, Changes to Taxation or Tariffs and lowering of remuneration and funding to Government Departments.
Treaty Decree which is any decree which negotiates:
Declaration of War.
Peace Negotiations and Signing.
Economic Treaties and Sanctions.
Membership and Withdrawal from International Organisations.
Annexation of Land and Returning of Annexed Land
Title Decree is any Decree relating to the Granting, Revoking and Amending of Nobility Titles and their associated territory.
The Emperor and Autocrat and Autocrat also has the ability to propose a fifth Decree, a Constitutional Decree which is described as any changes to the Constitution. The Supreme Court of Lehmark must review these Decrees and has the power to Veto the Decree if it is found to be unconstitutional, harmful to the State or a Citizen. However, the Constitution also allows the Emperor and Autocrat to override the decree "if deemed necessary for the continuance of a functioning government at which time the Decree in question will become law ".
The aforementioned power is more of an emergency measure, and has never been used.
The Constitution also described the Emperor and Autocrat as the "Executive of all Government Departments", meaning Ministers of Lehmark are responsible only to the Emperor and Autocrat, this also means that Ministers are able to be appointed and dismissed as needed, and policies and regulations of each government department can be changed by the Emperor and Autocrat at will.
The Emperor and Autocrat's Judicial Powers:
The primary judicial powers of the Emperor and Autocrat revolve around Supreme Court appointments. Such as appointing, the Chief Justice and Justices of the Supreme Court. The appointment would usually this would be based on recommendations from the Department of Justice, in saying that, the Emperor and Autocrat can ignore the advice and appoint his own choices. Typically these appointments would be for life, however if deemed necessary the Emperor and Autocrat can remove the Chief Justice or Justice from their position and re-appoint someone else to those positions.
The Chief Justice's primary function is to ensure the functionality of the Supreme Court and this involves appointing Civil and Criminal Magistrates to the Supreme Court, based on recommendations from the Department of Justice. However if the Emperor and Autocrat believes the appointments to be of poor choice, they can be overridden and he can appoint other people to those posts.
As previously mentioned the Emperor and Autocrat can also override the Supreme Court's Veto of a Constitutional Decree "if deemed necessary for the continuance of a functioning government...".
The Emperor and Autocrat also has some potentially very powerful abilities in the Supreme Court, which can mainly effect common law, judging and sentences, these include:
The Emperor and Autocrat can amend all Decisions and Sentences made by the Chief Justice of the Supreme Court, Justices of the Supreme Court, Civil and Criminal Magistrate’s of the Supreme Court.
The Emperor and Autocrat is allowed to act as an Honorary Justice on any Civil, Criminal or Constitutional Case and therefore can make decisions and sentences, while the sitting Judicial Member is recused.
The Emperor and Autocrat is the final “Court” of Appeal for all Civil and Criminal cases as the Emperor is the source of all law.
When the Imperial Florin was founded as a currency, the Department of Treasury begun issuing a weekly payment to the Emperor and Autocrat, similar to a wage or salary. However a review of current laws, found that since the Emperor and Autocrat wasn't an employee or civil servant he wasn't able to receive said payments. The Emperor and Autocrat refunded all paid monies to the Treasury of Lehmark.
It was decided that the Imperial Grant would be paid to the Emperor and Autocrat yearly to help him manage payments for services within the Empire. The amount was decided by Imperial Decree XLII to be 15,000f as a lump sum per annum, with the Department of Treasury reviewing the payment every 2 years.
Imperial Decree XLII also stipulates that the Emperor and Autocrat can arbitrarily increase or decrease the amount of the payment by simply making an amendment to the Imperial Decree. The Decree also stipulates that the payment can only be used to "carry out the duties of the office", however it does not specify what comprises duties of the office which leaves a wide jurisdiction of what the Grant could be spent on.
